General Terms & Conditions of Sale

SCOPE

The purpose of these terms and conditions is to provide you with all the necessary information regarding the purchase and sale of products and services through our website, which operates in Portugal and complies with the regulations of Decree-Law No. 24/2014 of February 14.

By accessing, navigating, using, or making purchases through our website www.servant.pt, you acknowledge and agree to abide by the terms described in this document.

Please note that these terms and conditions may be subject to change, and any updates will be at the sole discretion of Servant, Lda. The applicable terms are those in effect at the time of your product purchase.

We recommend that you review the current Terms and General Conditions of Sale on our website (www.servant.pt) before making any online purchase. It is your responsibility as a user to regularly familiarize yourself with these conditions.

 

1. COMMERCIAL POLICY 

The "seller" Servant, Lda. Servant has products for sale on the site www.servant.pt, and the "e-commerce" services are available exclusively to end users, hereinafter referred to as the "user".

 

1.1 THE SELLER

The term "Seller" refers to the company Servant, Lda that has products for sale on the website www.servant.pt, and the "e-commerce" services are available exclusively to end users, hereinafter referred to as the "user".

1.1 THE USER


The term "User" refers to any individual who accesses, browses, or utilises the services provided on the website www.servant.pt, whether for informational purposes or to make product acquisitions.

By using the website, the User agrees to utilise it solely for making legally valid inquiries and placing orders. The User explicitly grants Servant the authority to cancel any false or fraudulent purchases and to suspend or terminate the User`s access account in case of any fraudulent activities, misrepresentation of data, or misleading information during the use of the services.

The User must provide all the necessary information to place an order. This information may be subject to Servant, Lda`s Privacy Policy, where applicable.

When making a purchase or order through the website www.servant.pt, the User declares and guarantees that they have the legal right and capacity to enter into contracts.

 

1.3 THE PRODUCT

The term "Product" refers to any item, merchandise, or goods that are made available for purchase through the online store of the Seller. It includes but is not limited to furniture pieces, home decor, accessories, and other related items that the User can browse, select, and add to their shopping cart for potential acquisition.

The images displayed on the website are for representation purposes only. For accurate product information, refer to the description column on the product page. While every effort is made to reflect the products accurately, slight differences may occur due to material variations and manufacturing processes. For comprehensive details, feel free to request additional information via email to make an informed purchase decision.

1.4 Applicability of the Conditions

These general terms and conditions of sale govern exclusively the offer, transmission and acceptance of orders placed at www.servant.pt between consumers of the online store Servant (www.servant.pt) and the seller (Servant, Lda).

 

 

2. HOW TO ORDER 

2.1 Placing an order

To place an order at www.servant.pt, the User must have an active e-mail account and ensure that their browser is configured to accept cookies and pop-ups. These settings are essential to enjoy the full navigability and functionality of the online store Servant (www.servant.pt). It is not necessary to register as a user of the website (www.servant.pt). The order can be made without registration.

Placing an order at www.servant.pt generally proceeds as follows:

- Browsing and finding the desired products to purchase.

- Adding the selected products to the shopping cart.

- Confirming the chosen finishes or settings to ensure satisfaction.

- Selecting the preferred payment option.

- Reviewing the order details.

- Proceeding with the payment and confirming the order.

- Finalizing the purchase process.

- Receiving an order confirmation via email.

The order is confirmed when the "Confirm Payment" (Checkout) button is selected at the end of the purchase process. When Servant receives your order, the user receives the order number and all order details. The purchase agreement is finalized at that point.

An order confirmation will be sent to the user’s e-mail address. It is suggested to print or download this copy for future reference. We reserve the right not to accept the order, or to cancel it even after automatic order confirmation.

By submitting the order form, the user is accepting the general conditions of purchase, as well as other conditions existing at www.servant.pt, through links, including the General Conditions and Terms of Use.

Servant may not process orders that do not have sufficient guarantee of good collection; when orders are incomplete or incorrect, or the products ordered are no longer available. In these cases, you will be informed by e-mail that the sales contract has not been made and that the seller has not proceeded with the sale, specifying the reasons for this.

If the products displayed in the online store (www.servant.pt) are no longer available at the time of your last access or when the seller receives the order, the seller shall inform you of their unavailability within 30 days after receipt of the order. If an order has been placed and payment made for products that are no longer available, the seller will refund the money paid for the unavailable items. 

2.2 Right not to accept the order or to cancel the purchase 

Servant, Lda reserves the right to refuse any order for any reason. We also reserve the right to cancel any purchase (even if it has already been accepted by us), (among others) in the following situations, exempt from liability for any damages or costs:

- The product is no longer available / in stock (payments will be returned);

- The billing information is not correct or verifiable;

- The order is flagged by the Security Systems as an incorrect order or an order susceptible to fraud;

- The transfer for payment of the order has not been received by Servant within 5 days after acceptance of your order;

- Servant has reason to suspect that she is under 16;

- Servant has reason to suspect that you are a reseller;

- Cannot be delivered to the address provided.

2.3 Data Verification 

Upon receipt of your order, Servant may perform some checks on your order before we prepare it.

These checks may include address verification, credibility and fraud verification. With respect to fraud verification, Servant will perform partially automated checks on all orders to filter out transactions that are unusual, suspicious or identified as susceptible to fraud. Suspected fraud will be investigated and, if necessary, processed. By confirming your order you agree to these conditions.

3. WARRANTIES AND PRODUCT PRICE INDICATION

3.1 Payment Methods 

Servant accepts the following payment methods: Multibanco, MB Way, card payments, and direct bank payments. Additionally, for specific products you can make payments through bank transfer by contacting us via email at info@servant.pt. Servant does not accept any payment method other than those mentioned. Please do not attempt to pay by any means other than the ones specified. If you do so, we cannot be held liable for loss of payment or any other damages that may result.

 

3.2 Payment processing

 

In the case of Credit Card payment, all details (e.g. card number or expiration date) will be sent by encrypted protocol to the company that provides the remote electronic payment services, without any third party having access to the transmitted information.

 This information will not be used by Servant, Lda, except to carry out the necessary procedures for the purchase or refund, in case of return, in accordance with the exercise of the right of return or for reporting to the police, cases of fraud.

 The purchase price of the products and the shipping costs, as indicated on the order form, will be charged to the current account when the purchased products are actually purchased.

 

4. ORDER SECURITY 

4.1 The online store www.servant.pt utilizes strong security technologies from the available encryption platforms.

 

Your payment information will be encrypted from the moment you enter it until your transaction is processed and will not be stored on a public server. Although we use encryption software, the security of information and payments transmitted over the Internet or via e-mail cannot be guaranteed.

Servant, Lda shall not be liable for any damages incurred as a result of the use of electronic means of communication including, but not limited to, damages arising from failure or delay in the delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for communications or virus transmissions.

If you choose to pay by ATM reference, we will start processing your order after we have received your payment. This may take several days. Once 5 calendar days have passed after placing the order, and if we have not received any payment, the order may be cancelled.

Payments can only be processed if the information to be used for billing can be verified.

 

5. RESERVATION OF TITLE

Servant, Lda retains ownership of the company`s products until it has received full payment for all such products.

 

6. PRICES

6.1 The prices of the products displayed on the site include Value Added Tax (VAT). Shipping rates are applied per order. The exact price of the shipping fee will depend on where your order will be delivered.

6.2 Prices are all quoted in euros. Please note that a change of location or country of delivery may have an influence on prices due to transport costs.

6.3 Your total price  

The total price specified in the final checkout menu includes taxes and shipping costs. Prices are quoted upon order confirmation, which you can print or download for future use. Please pay only the exact amount specified in the order confirmation and make individual payments per order.

  

6.4 Price changes 

The prices of the products shown on the site are subject to change. Servant, Lda reserves the right to change prices without notice. The prices displayed at the time of purchase are the prices applied to that purchase.

 

6.5 Errors in prices 

Please note that even though the site is updated with extreme care, it is possible that the price information on the site may contain errors. Servant, Lda does not commit to the offer and reserves the right to cancel your order, should such an error occur, communicating the situation immediately to the user / consumer.

 

 

7. QUALITY AND WARRANTY 

Servant, Lda does not sell second hand products, with defects or of inferior quality to the standards of those existing in the market, with the exception of specifically identified cases of sale of display products that may have some sign of use. The main features of each product shown in www.servant.pt are on each product page.

The products offered for sale on www.servant.pt may not exactly match the actual material in terms of image and colors, due to the Internet browser and monitor used.

If you decide to exercise the right to return the purchased products, Servant, Lda has the right not to accept the return of products that are returned without the label, original packaging, or that have been altered from their original state or damaged.

 

8. SHIPPING AND DELIVERY

8.1 Delivery: where and when 

We deliver products Monday through Friday from 9am to 6pm, and in some cases, may also occur on Saturdays. We do not ship on certain holidays. Orders placed on weekends or bank holidays will be processed on the next business day.We can only fulfill the delivery of an order if the delivery address is a home or office located in one of the countries/locations that are part of the Portuguese territory and Spain (with the exception of islands).

To receive the order it is necessary to ensure that someone is at the address. This service does not include the option of scheduling or appointment, so the delivery of the order will be made without prior contact by the carrier. We do not ensure this deadline during periods of promotions, sales, Christmas and out of stock. A delivery is considered made or a product is considered delivered when the delivery receipt is signed at the agreed address.

 

8.2 Delivery Deadlines 

The estimated time of availability and expected delivery time will be indicated on each product page. After order confirmation, Servant will contact the supplier to consult the best delivery time, being this way, dependent on that answer. Servant undertakes to make every possible effort to ensure that no delays occur, but cannot in any way be held responsible for changes in delivery times since these are impacted by all the logistics that precede receipt of the goods at the warehouse of Servant.

Whenever possible and whenever the product is in stock, Servant will do everything to deliver orders within the foreseeable period of 15 (fifteen) days. The delivery of products that are not in stock and require a supplier order, will be made after the arrival of the last item.

Delivery or shipping to the islands (Azores and Madeira), may require a longer time, due to the constraints inherent to logistics methods and available transport.

In the event that the timeframe indicated suffers any change, Servant undertakes to inform the client as soon as it becomes aware of such fact. However, Servant cannot be held responsible for delays not attributable or not communicated to Servant.

Servant, Lda will not be liable for non-performance, or delay in performance, of any obligation that is due to a Force Majeure Event, i.e. an event, act or omission beyond its reasonable control (Force Majeure Event - which comprises any event, act or omission beyond the reasonable control of "Seller").

 

8.4 Inspection on delivery 

Upon delivery, the customer should inspect the packaging for damage. If you find that the products are damaged, the customer should not accept delivery of the order, which will be returned. Servant, Lda will refund the amounts paid for the order and for the shipping, as soon as the warehouse receives and completes the return process.

Any claim of non-receipt of order should be made within 30 days from the date of order placement. After this period, Servant, Lda will not be responsible for the loss of the order.

 

8.5 Store pickup

We also offer delivery to the physical store Servant, which you can find when selecting the shipping method for your order (Store pickup). You will be informed when your order is available for pickup.

 

 

9. SENDING RATES 

9.1 Shipping rates are applied per order. The exact price of each shipment depends on the delivery location. The amount will be calculated at the end of checkout.

 

9.2 Free shipping

If you place an order that exceeds the minimum order value defined for your country or campaign, we will ship at no cost, i.e. free of charge.

 

 

10. RETURNS AND CANCELLATIONS 

Servant strives to make sure that all shipments and orders are handled as efficiently as possible. If you wish to make any changes or cancel your order, please contact us as soon as possible to see if it is still possible.

However, you may return your order within 15 days of delivery. Returns of customized or made-to-measure products are not accepted.

10.1 Order cancellation before shipment 

No changes or returns will be accepted for custom or made-to-measure items, since production and customization is already underway. Unfortunately, if the shipping process has already started, the change or cancellation will no longer be accepted. However, you may return your order within 15 days of delivery. Returns of customized or made-to-measure products are not accepted. If the cancellation request is accepted and successful, the customer will be notified by e-mail of this decision and the cancellation will be processed at no cost to the customer.

 

10.2 Return of defective products 

The customer has the right to return delivered products if they are found to have defects or other non-conformities with the ordered products. The return can be made within 15 days after receipt of the order. This does not affect your statutory rights. If your complaint is justified, the price and shipping costs will be refunded. 10.3 Return of products due to withdrawal

If for any reason you are not satisfied with the products you ordered you can return them within 15 calendar days of receipt, provided that:

- The products have not been used or damaged;

- The product retains its original characteristics and the packaging is undamaged (carefully opened packages will not be considered damaged);

- Cannot return: products that have been tampered with.

10.4 Returning gifts 

Currently, it is not possible for a person who has received a product as a gift from another person to return it. In this case, in order to proceed with the return you should contact the person who bought it, so that they can return it, according to the Return Conditions.

 

10.5 Exchange of products or sizes 

We will not accept exchanges of items for another or to exchange sizes. If you are eligible, you may return the item if you wish.

 

10.6 Return information 

If your return is justified by a defect or nonconformity with the ordered products, Servant will bear the shipping and return shipping costs. If your return is made for reasons other than a justified defect or nonconformity of the ordered products, Servant will not refund the shipping costs. However, for some cases, when making a return you will be using our shipping provider. As the costs incurred by Servant for the return are equal to the shipping costs, Servant will not refund the shipping costs initially incurred by the customer for the respective order.

 

Refunds will be made based on the payment method. If the customer pays by ATM reference it is necessary for the customer to provide their bank details to our Customer Service department when initiating the return process. The customer will receive a refund after the product(s) have been returned and processed.

 

For additional information about the return process and refund times please refer to the FAQ section of the website. Please read the help instructions in that section and follow the instructions carefully to AVOID unnecessary delays.

 

10.7 Store returns

You can also return your order in the physical store Servant. To do so, you must go to the store and ask an employee to carry out the process for you, or do it directly through the website, and then go to the selected store within 5 days to finalize your return. The store will take care of sending your order to the logistics center and, afterwards, Servant will proceed to refund you or send you an exchange order.

12. CONDITIONS APPLICABLE TO CAMPAIGNS AND PROMOTIONAL CODES (DISCOUNTS) 

12.1 When used in accordance with the established rules, a promotion code entitles the user to take advantage of a promotion/discount on the purchase of a specific product or for a set of products during the period indicated/associated with the promotional code or promotional campaign.

 

12.2 Promotional codes and campaigns may only be used on online purchases made on the website. It is not permitted to sell, exchange or give away a promotional code. The customer holding the promotional code may not upload or make available a promotional code on any website or other public form of gift, donation, sale or exchange. Use of promotional codes for commercial purposes is not permitted.

 

12.3 The promotion code is connected with the brand Servant. It is not permitted to use the promotional code in connection with another brand, company or name. It is also not permitted to use the promotional code or campaign in an illegal, abusive or disrespectful way, as well as in any other way that may damage the reputation of Servant.

 

12.4 Promotional campaigns are limited to existing stock, unless expressly stated otherwise. The use of the promotional code is conditioned to only one use per product and per order, unless expressly stated otherwise. Promotional codes cannot be combined with any other promotions or special offers.

 

12.5 Promotional codes are not exchangeable for cash.

 

12.6 Servant has no obligation to re-issue or refund promotional codes. However, in the event that Servant decides to re-issue or refund a promotional code, you need to have access to the initial promotional code. To do so, you must keep a copy of your promotional code, otherwise it cannot be re-issued or refunded if it is lost.

 

12.7 In cases where Servant reissues/refunds the promotional code, the discount of that value may only be applied to a purchase of equal or greater value than the purchase on which the discount/promotional code was issued.

 

12.8 Without prejudice to any other rights, Servant may have the right to immediately invalidate the promotional code if Servant has reason to suspect that a promotional code is being used in violation of the aforementioned conditions, for usurpation or in other cases where Servant has reason to do so.

 

13. AVAILABILITY 

Satisfaction of all orders placed on the site is subject to availability. Servant tries to ensure that all items offered for sale on the website are in stock or available for order from the respective supplier. However, Servant reserves the right not to accept any orders or to cancel orders already confirmed for products that are out of stock. In these cases, Servant will inform the customer of this fact and proceed to refund the amount paid.

 

14. VALIDITY OF THE PROMOTION

Offers on the site are valid only for the time they are displayed on the site, unless otherwise communicated on the site. Servant is not bound to any offer if there are errors or mistakes in spelling, pricing or other errors in the information on the site. Servant reserves the right to cancel any purchase and sale concluded under such errors.

 

15. RESPONSIBILITY

15.1 Servant shall only be liable for damages suffered by the Customer in the event that such damages result from breaches attributable to Servant `s contractual obligations to the Customer, or in the event that Servant `s liability results from applicable statutory law.

 

15.2 In case the customer has suffered damages related to the activity of the website, the liability of Servant will be limited to:

- Damage to products sold by Servant or other materials;

- Reasonable and verifiable costs incurred by the client to find the cause and amount of compensation attributable to the damage;

- The maximum reimbursement for the above indemnity will be (if applicable) the price of the products concerned.

 

15.3 Servant cannot be held liable for damages suffered by third parties resulting from the use of any of our products. Servant shall not be liable for damage suffered by you as a result of improper use of our products.

 

15.4 Servant is not responsible for damages that result from incorrect information on the site.

 

15.5 In the event that Customer suffers damages that are the result of gross negligence or willful misconduct on the part of Servant none of the limitations contained in this article shall apply.

 

16. APPLICABLE LAW 

These general conditions and all disputes arising in connection with these general conditions, including their validity, the use of the site or any purchase therefrom shall be governed by Portuguese Law.

 

17. CHANGE OF TERMS & CONDITIONS

Servant has the right to amend these Terms & Conditions at any time. You shall be subject to the principles and terms in force at the date of your order unless the law or competent authority imposes any change to them.

 

18. INFORMATION ON THE SITE 

Although Servant works on its site with great care, the information, texts, graphic documents, movies, music and/or other services may contain errors or be incomplete or incorrect.

 

Servant cannot be held responsible for any damages resulting from the use (or inability to use) the site, including damages caused by viruses or any inaccuracy or imperfection of the information, unless such damage is the result of intent or negligence on the part of Servant.

 

19. TRADEMARKS AND COPYRIGHTS OF THE SITE 

All brand names, product names and titles used on the site are trademarks or registered names of Servant or trademarks and registered names of other holders.

 

The user/customer of the site is not authorized to use or reproduce any of these trademarks or registered names as this is a violation of the rights of the owners.

 

Everything concerning the design, texts, documents, films, music and/or other services of the site, the selection and organization thereof, as well as all software compilation (including applets) and all other materials on the site are the property of Servant and its suppliers.

 

Users/customers are only permitted to electronically copy and print portions of the site if this is necessary to place an order on the site or to use the site as a source for a purchase.

 

The user/customer is not authorized to make any other use of the site or the information and materials contained therein, including reproduction for purposes other than the above, modification, distribution or republication.

 

Should the user/customer wish to use information or materials from the site, prior written permission must be obtained from Servant.

 

20. GENERAL CONDITIONS OF THE E-GIFT

E-gifts purchased or issued through our online store are for use only at www.servant.pt.

 

Once an e-gift is purchased or issued, it is not convertible to cash and cannot be refunded by any other type of payment (bank transfer, VISA/MASTERCARD or Paypal).

 

If in your return you have selected the e-gift refund method, it will be sent to the email address in your order, as soon as we validate the conformity of your item after receipt in our warehouse.

 

This e-gift, generated as part of a return, is not convertible into cash or the payment method used by the customer in the original order.


Chargebacks on e-gift orders will always be returned by the same method, i.e. e-gift.


An e-gift can be used on purchases worth more or less than your balance. If your purchase amount is higher, you will be asked to pay the remaining amount. If the amount of your purchase is less, your e-gift code keeps the excess amount on balance. Your e-gift can be used for as long as you have a balance.


You can check the balance of your e-gifts at any time by accessing your Client Area. The acquisition of e-gifts cannot be combined with campaigns, discounts or promotions.


The use of e-gifts is valid on any item and can be accumulated with campaigns, discounts and promotions. The use of e-gifts is only allowed to registered customers.

 

21. TAX FREE

Tax free shipping is possible for a minimum order of 50 euros plus VAT, and the customer has 2 months to place the order. The billing address of the order is always the delivery address of the order (i.e. EU).


In order for us to send you the tax free document, please follow the steps below:

- Download the invoice

- Go to customs with the invoice and fill out the tax free form

- The 2 documents must be stamped and validated by customs

- Send the following physical documents to Servant (the client must keep proof of submission).
° Stamped invoice
° Stamped tax free form
° Photocopy of passport
° Bank account number for refund
